Terms of use
1. Provider
REFABS is provided by BY 7 d.o.o., Tehnološki park 18, 1000 Ljubljana, Slovenia, registration no. 9481095000, VAT ID SI88032248 ("we", "us"). See the imprint.
2. Scope
These terms apply to refabs.eu and to the application at app.refabs.eu (together, "REFABS"). By creating an account you accept them. How we process personal data is described in the privacy notice.
3. What REFABS is
REFABS helps you design a modular house with the help of AI: from your brief it generates house designs, 3D models, renders, budgets and element lists. All of these are concepts and estimates. They are not construction documents, they do not replace a licensed architect or engineer, structural calculations or a building permit, and budgets and prices are indicative, not an offer. Element availability and delivery times are not guaranteed. AI-generated output can contain errors, so check it before you rely on it.
4. Accounts
You must be at least 18 years old. An account is personal: give accurate information, keep your sign-in secure, and do not share the account. You are responsible for what happens in your account.
5. Your content
You keep the rights to what you upload and enter (briefs, prompts, images, plans). You confirm that you have the rights needed to upload it and that it does not infringe anyone else's rights.
You grant us a non-exclusive, worldwide, royalty-free licence to store, process and display your content to provide REFABS, and to use your content and the designs generated for you for research and development, including to train and improve our own AI models, as described in the privacy notice. The licence for research and development ends for new uses when you object or close your account.
You may use the designs, images and documents REFABS generates for you for your own house project, including discussing it with your advisers and with us. REFABS itself, its software, element library and design system remain ours. Other users may receive similar designs.
6. Acceptable use
You may not:
- upload unlawful content, content that infringes the rights of others, or other people's personal data without a legal basis;
- attempt to access other users' data or to break, probe or overload REFABS;
- get around usage limits, use bots or scripts to generate at scale, or scrape REFABS;
- resell access to REFABS, or use it or its output to build a competing service or AI model.
7. Fees and limits
REFABS is currently free of charge. Daily usage limits apply to generations, renders, videos and sketch uploads. If we introduce paid features, we will show the price before anything is charged, and paid features will need your separate agreement.
8. Availability
REFABS is under active development. We may change, interrupt or discontinue features, and we do not guarantee uninterrupted availability. We tell you about planned discontinuation of the service in advance.
9. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever mandatory law requires. Otherwise, as REFABS is provided free of charge, we are not liable for indirect damage, lost profit, or decisions you make on the basis of generated designs, budgets or prices. Nothing in these terms limits the rights you have as a consumer under mandatory law.
10. Termination
You can stop using REFABS and ask us to close your account at any time by writing to info@refabs.eu. We may suspend or close an account that breaches these terms or misuses REFABS. If we close the service, we give reasonable notice in advance.
11. Governing law and jurisdiction
These terms are governed by the law of the Republic of Slovenia. The courts of Ljubljana have jurisdiction. If you are a consumer, you also keep the protection of the mandatory law of your country of residence and may bring proceedings there.
12. Changes to these terms
We tell you about material changes by e-mail or in the application at least 14 days before they take effect. If you do not agree, you can close your account before then. Continuing to use REFABS after that date means you accept the new terms.
